Seeing people saying that they’re taking their sweet time with that schedule. The order was that it would be scheduled that week. The Court does not generally hold OA on Thursdays. Usually Monday through Wednesday, so Thursday is out of the ordinary.

Yes, the Court has moved some cases faster, like the lightening speed Pentagon Papers case. But this is pretty quick for a case that doesn’t have a built in decisional deadline.

What if I fully expected the result for practical and policy reasons, but think the reasoning is still atrocious, undercuts the originalist principles that the majority of Court purports to decide on, further upends the federal power/federalism balance (based on a seed Justice Story planted wrongly ages ago), and extends its holding far beyond what needed to be addressed with minimal justification, particularly when there’s a much more intellectually honest method to get the Court where it obviously wanted to go?

Here we go again: Someone replies “we DESERVE” who we get in elections… Me: No, we didn’t DESERVE Trump. (There were dirty tricks, election interference, 7 million more for Hillary). He then felt he had to explain we don’t use pop vote in elections. No kidding. I asked that he “please don’t twist my words, my issue was “DESERVE”. His reply? “I’ll make a conscious effort to passively consume your content without further engagement moving fwd.”

I never sugg he shouldn’t opine. Debating here is 🤪

I really don’t think the average person realizes that all of these close calls also are a giant waste of government resources as government employees are forced to spend time preparing for a shutdown. Yes, the shutdowns are worse as services are curtailed (and you end up paying the employees when it reopens for time they were furloughed) but even getting close is an absurd waste of tax dollars too.

Not necessarily. The decision is by the DC Circuit. If SCOTUS denies the stay and denies cert, that doesn’t necessarily mean an endorsement of the DC Circuit decision.

So the DC Circuit decision would be persuasive, but not binding, because Cannon is in the 11th. She’s not required to follow decisions of the DC Circuit, just decisions of the SCOTUS and the 11th.

That’s assuming they took the case on the merits, which I’m suggesting is not the likely way for them to rule against him with a very good DC Circuit opinion. IMHO it is the more likely is for them to deny his stay request and deny certiorari. If the Eleventh loses its mind in the Florida case (assuming Cannon rules quickly) and conflicts with the DC Circuit, then they’d have to get their hands dirty.

Yes. He can either deposit the judgment with the court or purchase a bond while on appeal. The former would be returned to him in its entirely should he be successful on appeal. The latter would not be money he sees again, but he wouldn’t have to deposit the entire judgment. Also notable is that post judgment interest in New York accumulates at 9%.

Evidence at trial was that he has $400M cash on hand. A bankruptcy petition, in addition to being subject to claims of fraudulent bankruptcy, would be politically disastrous.
