Am lamenting anew the refusal by Biden to support Supreme Court reform when Democrats controlled the House and Senate and could have expanded the Court, neutralizing the power of demonstrably corrupt Justice Thomas and the justices appointed after Mitch McConnell illegitimately refused to advance Obama’s nominee to the seat that went eventually to Gorsuch. Elected Democrats must take foundational measures if we are to preserve any sort of meaningful democracy in America. 1/

To accomplish Supreme Court reform, Senate Democrats in Congress should have modified the filibuster rules or eliminated filibuster altogether. 2/

Biden removed their incentive to do this by indicating he was not prepared to support Supreme Court reform. 3/

Honestly, the Supreme Court justices today sounded even more deranged and clueless than I even expected. They are just too worried about hypothetical future presidents to focus on the fact that we have a former president indicted for attempting to overthrow an election who is now running for reelection on an explicitly authoritarian, anti-democracy platform. 1/

Gorsuch, Kavanaugh, and Coney Barrett clearly cannot bring themselves to face that Trump is anathema to rule of law because what would that say about them? 2/

Several of my law professor colleagues have separately told me that today is the worst day for Supreme Court since Dred Scott - and these are colleagues who understand just how awful Dobbs, Heller, and Bruen were. 3/

Meanwhile, in my closing remarks to the first year law students on the last of torts, I directly discussed the challenge they face entering the American legal profession when so many of its most visible members are simply shilling for a political movement that holds American law and governmental design in contempt. 4/

Alito, Gorsuch, Kavanaugh all seem blatantly more committed to maga-ism than to justice, let alone to pluralistic democracy. Thomas is bought and paid for. Roberts and Coney Barrett can’t seem to summon the clarity of mind and the courage to stand on the right of history. 5/

What a contrast to judges like Arthur Engoran, Juan Marchan, and Tanya Chutkan, judges who, without sacrificing law and legality, have shown that the law need not kowtow to Donald Trump. Ditto for the majority of the Colorado Supreme Court. 6/6

Pagliery:

Trump is sitting at the defense table, with Todd Blanche at his right and Emil Bove at his left, plus Susan Necheles at the far left.

Blanche is explaining something, waving his right hand around while Trump nods in approval.

Dozens called for jury duty are downstairs and going through metal detectors.

The judge just sat down. We begin.

Sometimes one is weirdly able to worry simultaneously about the most mundane personal matters and the most serious global and national ones. Today, worrying about the situation in the Middle East does not put into perspective the stress of packing up my household for a long-distance move. Instead, my psychic perspective is flattened, with concerns about both occupying the same plane. Know what I mean?

There are a ton of posts about Trump's video, which I won't watch, but the posts alone are chilling.

Via Ben Meiselas:

Pres shared a video praising hardworking American families & how his job is to help all American families

MeidasTouch:

shared an article & video calling anyone who doesn't support him "America's enemies" who need to be taken care of & saying that fear that he is "another Hitler" is a "reason for hope." [+ "his MAGA followers are on standby to “fight for him"]

@GottaLaff You are wise not to watch but to pay attention. It is very hard to strike the right balance between not exposing oneself to Trump’s stunts and giving him while also not falling into complacency and remaining vigilantly aware of his evolving dangerousness.

Congratulations to Maria Rodriguez, a candidate supported by of my favorite organizations, Run For Something (they help young liberal and progressive candidates run for office), who won her race for Pembroke Pines City Commission in Florida.

It’s officially a non-partisan office, but Ms. Rodriquez ran on a progressive platform and was endorsed by the SPLC and national and local Florida Democrats.

@TonyStark Hi Tony. An alum of a program I founded and run, Leaders from Law (educates and trains rising progessive lawyers to run for office), is now a candidate for office. Like Maria Rodriguez, Ashwin is running in a red state, Georgia, for state senate. Hoping to give him a boost here on . Here’s Ashwin’s launch video. https://youtu.be/Zhn6IqZr4ec?si=MmAghkawW7nnvaOe

One of Trump’s authoritarian tactics is to wear us out through the emotional labor of having to manage our and others’ reactions to him. The managing is necessary because he is too dangerous to simply ignore, and dealing effectively with the menace he and the Republican cult requires steely calm opposition. 1/

heidilifeldman OP ,
@heidilifeldman@mastodon.social avatar

I would guess that people of color also recognize the dynamic of having to deal with a dangerous white man while all the while managing their emotions in order to do what is necessary to oppose him. (I say “guess” because I can’t speak from personal experience nor any particularly scholarly expertise on this point.) 3/

Trump’s constant barrage of bad behavior, threats, and references to violence are all weapons he is using against all of us. 4/4
