Here is the timeline:

— Jack Smith was appointed on November 18, 2022.
— He indicted Donald Trump in relation to mishandling of classified documents on June 9, 2023.
— And today, 605 days after Jack Smith’s appointment, Trump appointed judge Aileen Cannon dismissed the entire case, claiming that appointing Jack Smith is against the US constitution.

@randahl What should happen TODAY is Hunter Biden's attys should petition to have his case dismissed in its entirety because the special prosecutor in his case has the same authority & funding that went to Jack Smith.

Watch to see how quickly a decision to uphold special prosecutor position will happen.

Fight fire with fire. Argue like cases the same. What's good for the goose is good for the gander. .

This leaves us with only two possibilities:

A. US tax payers have payed for 605 days of expensive legal work which are a violation of the constitution, in which case one has to wonder if Merrick Garland will keep his job, or

B. Aileen Cannon’s decision will be overturned on appeal, in which case one has to wonder, if she will get to keep her job.

@randahl Actually, she could be upheld on appeal by the Trumpy , which has already essentially placed him above the law, without that reflecting negatively on Garland at all. I'd actually rate that as the highest probability, unless Roberts decides the only way to avoid real court reform is to dial it back for a little while.

@randahl The notion that Trump and his lawyers were able to find a Constitutional violation that Clinton and his lawyers couldn’t, seems unlikely to me. Other explanations come to mind.

Can Cannon be removed by the 11th Circuit? She was appointed by a president, so does that mean it requires impeachment in the House and conviction in the Senate?

@bruce in theory, she can be removed by the 11th Circuit. There has already been one attempt to do so, although at that point in time, an 11th Circuit Judge decided not to remove her.
