So you shut down your business, even if the courts decide "technically correct" on rehiring, your old business is still on the hook for back wages.

"shutting down" doesn't magically absolve you of financial obligations.

Well, except defrauding the finding that you pay back wages and reinstate (with union) the employees you fired probably means you still gotta reinstate them and allow them to keep a union. And now you have a very hostile workforce who will all but ensure any new hires are pulled into the union. So really just a colossal mistake as far as I can tell.
