@GottaLaff it will be appealed. Whoever loses the appeal will push it to the Supreme Court. Lord knows what will happen at that point. The thing is is that for Trump's purposes and judge Cannon's purposes that doesn't matter. All of that will take enough time so that there's no way that the trial will continue enough before the election to matter. Had any other judge received this case it would have moved faster and probably would have been decided before August. Now we're talkin 2025.
#AileenCannon dismissed the #indictment on the grounds that #SpecialCounsel#JackSmith was improperly appointed.
Cannon’s ruling is a remarkable win for Trump, whose lawyers have thrown longshot argument after longshot argument to dismiss the case. Other courts have rejected similar arguments to the one that he made in Florida about Smith’s unlawful appointment.
“Upon careful study of the foundational challenges raised in the Motion, the Court is convinced that #SpecialCounsel’s Smith’s prosecution of this action breaches two structural cornerstones of our constitutional scheme—the role of Congress in the appointment of constitutional officers, and the role of Congress in authorizing expenditures by #law,” #AileenCannon concluded in her 93-page order.
Cannon, found that because Smith had not been named to the post by the president or confirmed by the Senate, his appointment was in violation of the #AppointmentsClause.

#ClarenceThomas argued that the #SpecialCounsel’s office needs to be established by #Congress & confirmed by the #Senate. He said he tacked on his concurring opinion to the #immunity ruling to “highlight another way in which this prosecution may violate our constitutional structure.”
“If there is no #law establishing the office that the Special Counsel occupies, then he cannot proceed with this prosecution. A private citizen cannot criminally prosecute anyone, let alone a fmr President.”
#SCOTUS is supposed to rule this morning on #Trump’s claim that he is immune from prosecution on charges of trying to overturn the 2020 election.
The decision will determine whether & how special counsel #JackSmith’s case against Trump can proceed — although it’s unlikely a trial would happen before #Election Day. But the ruling could also set an important #precedent for how to prosecute presidents for their actions in office.

Judge #AileenCannon is skeptical that #evidence from #MarALago should be thrown out – she was not receptive to the defense’s complaints about the 2022 search of #Trump’s home.

@Nonilex Prosecutors should be taking a “tone” with Cannon. She is putting FBI agents at risk and her hearing is the definition of a kangaroo court. She is going to have blood on her hands.

Keep in mind that prosecutors presumably would most like Nauta and De Oliveira to flip on Trump. There are matters that they cannot fully understand w/o Nauta's truthful testimony, including why he went back and what happened to still-missing docs
