So, glaring at Maggie is a ruse. She is, as she always does carrying water for him. The plan is for him to pretend to sleep in court and Maggie to call everyone's attention to his dozing. And he then pretends to be angry with Maggie to make it seem like they are not in cahoots. They've been running this con for a decade.

He's in danger of going to jail, so he probably didn't sleep well last night. Maybe he decided to take a sleep aid at 2 a m., and hadn't shaken it off yet. Occam's Razor says he just nodded off.
