@3x10to8mps Because how would she not be? Smith can't just say, I want her off. He needs an airtight case to make to the 11th, which is filled with conservatives. It's not easy to get a judge removed.
@GottaLaff Oh agreed. But she's been sternly overturned by the 11th once already and has made 2 other questionably partisan decisions. If he's waiting for her to make one blatant mistake, it won't happen. But there's definitely a pattern of favoritism already.
And the 11th knows the eyes of history are on them (and hopefully they still esteem the judicial code of conduct)
Trump asked for postponement till 2025 and Smith wants July 2024. So we'll see what she does tomorrow. Blech!
She will stay on the bench regardless, barring impeachment and removal (yeah right, 2/3rds vote in senate). But the appellate court can order her off the case, to be replaced by a random judge from the district.
@GottaLaff coming from Jack Smith, this seems like incredibly strong language. He seems incredibly competent, restrained, and (in the good sense of the word) conservative. Has he finally had enough from Canon, or did he catch her in a clear unforced error?
@GottaLaff We see more and more daily how damaging McConnell and Trump judicial appointments will continue to be to this very very fragile democracy. It breaks my heart, frankly.
