@GottaLaff It seems like this more appropriately should have been a pretrial motion in limine to preclude Carroll testifying about emails she deleted.
But Habba is not the most experienced counsel, so instead tried to get relief after-the-fact when it was too late.
Hard to believe a self-proclaimed billionaire can't retain competent counsel. But that's what happens when you engage in self-destructive behavior during trial which no respectable lawyer would tolerate, & stiff your lawyers.
