The circular magazine Tommy machine gun used by Al Capone had a theoretical capacity of 600 rpm. The Clarence Thomas approved bumpstocks increase the capacity of semi-automatic weapons in private hands to a theoretical 800 rpm.

In 1934 the US deemed the Tommy gun too lethal for private ownership and passed the National Firearms Act. 90 years later, the MAGA SCOTUS has determined the higher 800 rpm fire-rate is irrelevant, and placed bullseyes not just on law enforcement but on school children across the US.

@pattykimura While I consider bump stocks to be machine guns by the letter of the law (and therefore should require special licensing) the dumbass argument the court is making is that the stocks do not count as a machine gun part. The rate of fire is irrelevant because it's not a part of the law, the mechanical function of the gun is what's codified. You could argue that rate of fire should be a consideration (I wouldn't, that would be a bitch to enforce) but as it stands, it isn't.

@pattykimura So the American legal definition of a machine gun is any gun that can fire more than one bullet in succession through a single press of the trigger (paraphrasing). The court is arguing that because the stock moves the trigger out of contact with your finger, each round fired comes from a separate trigger pull. This is a mostly bullshit argument because the operator action is continuous and you make no separate action to press the trigger.

@pattykimura Your finger essentially becomes a mechanical part of the gun and the trigger application is really moreso pushing the upper receiver forward, which is a continuous action on the part of the shooter. (The trigger need not be a hook for your finger.)

In my view, bump stocked rifles meet the current definition of a machine gun.

Anyway the court is making bullshit arguments like they often do.

@Iwillyeah @pattykimura Trying to decide on and enforce a "certified" rate of fire would be a bureaucratic nightmare. To begin with, pretty much every semi-auto gun can theoretically fire at nearly the same rate as a full-auto variant, the limiting factor is how fast you can pull the trigger. You can up your trigger pull rate pretty high with a few different techniques that sacrifice accuracy for speed. In fact, the bump stock was inspired by one of these techniques...

@Iwillyeah @pattykimura You don't actually need a bump stock to bump fire. So in order to get below theoretical maximums equal to full auto, you have to switch to something like a fully-manual bolt gun but outlawing semi-autos simply isn't going to happen in the US. Trying to adjudicate how fast a normal person can reasonably pull the trigger of a particular model is a fuzzy nightmare I wouldn't want to leave up to interpretation. Laws are much easier to enforce with fewer judgement calls.

@Iwillyeah @pattykimura To add to this, full-auto rate of fire is somewhat variable, dependent on things like ammunition, barrel, if there's a suppressor attached, the size of the gas port, how tightly you grip the gun, etc. Now, most of these variables are small, but you know manufacturers would certify with the slowest version of their gun, and we'd end up with extra lawsuits about just how fast a particular gun can fire.

Better to base the law on mechanical principles, which....

@Iwillyeah @pattykimura are harder to make blurry and messy than something like "how fast can you shoot it?"

Notice that my argument for why a bump stock is a machine gun (and why others say it's not) comes down to interpretation of mechanical principles and terms. (Which part is the trigger?) We want to minimize the amount of interpretation needed to apply the law, and a rate-of-fire law would require lots of interpretation for what counted as a valid demonstration of rate.

@Iwillyeah @pattykimura Firearms manufacturers don't advertise rate-of-fire, as far as I know. It would be irrelevant to the vast majority of people. Anyone can quickly learn to bump fire, it's just they also quickly learn you couldn't hit a buffalo doing it. Regardless, it's not that it's impossible to set up a rate-of-fire legal structure, only that doing so is a lot of expensive bureaucracy for little-to-no gain.

AFAIK, "trigger" can be applied to mean anything that fires the gun, but IANAL.

@Iwillyeah @pattykimura It really is just for Rambo and people who want to feel like they're giving the ATF the middle finger. The more level-headed folks call it "turning money into noise." There's a small-but-visible section of the firearms community that drools over anything that tries to skirt around ATF regulation: bump stocks, binary triggers, smooth-bore rifles, etc. Pretty much all of them are worse than a regular firearm, in a practical sense.

Any business folks know anything about Aptera and their market potential? I believe they can make it to production at this point, and I believe their car can meet their claims (or get close enough). What I'm concerned about is that I think the 2-seater eco-tech car market is tiny. I don't know if it's big enough to sustain the company long term. But they also have side projects going on, so....

@alexisdyslexic They're promoting their 47k order waitlist, but I don't have context for that. Is that average? What's the conversation rate for an EV waitlist? I do like that they're placing an emphasis on their manufacturing efficiency. I guess they could "hard" pivot and put out a more normal looking car as their 2nd model, I just have a hard time seeing "normies" accepting such a weird looking thing.

I'm trying to decide if I should buy in and my CFS prevents me from doing indepth research.
