So, they started renting out the sidewalk (without asking) and were upset that the DOT made them stop rather than let it go on while they tried to work out what regulations applied? Why can't I put up warm pop tents for unhoused people and not charge for them?
They might have a case if they set this up for free— as a convenience for customers. But— this is that whole “just take it and see if anyone stops you, if they do cry 😢 “
