I had surmised this as well. I was sure 🙄 he would file before the weekend, and also that they would have been ready for this as soon as 2nd circuit had delivered their decision.
@PandaChronicle@Wileymiller It feels in my fantasy-thoughts like Smith has all kinds of different documents and motions ready to go, and he just fans through them, pulls the right one out, and delivers it. That's how far ahead he thinks.
@GottaLaff@Wileymiller That was my thought as well. that even while 2nd circ was cogitating, he was gaming out all the possible responses & writing briefs for each one. He is some kind of impressive.
DoJ argues further that the SCOTUS denial to grant cert in December reflects the court's inclination not to review the case on the merits, and that even though DoJ wanted them to back then, the DC Circuit's ruling on the matter should close the matter.
But, if the court decides they want to rule on the matter and not simply deny the stay application, DoJ asks that they treat the stay application as a petition for cert and resolve it on an expedited basis. DoJ suggests arguments in March.

So he's giving SCOTUS a choice...deny the stay and let justice take its course or be a tool for the defense but at least have the common decency not to slow-walk it as they've had months to prepare for this eventuality.
