It's illegal to sell unless you were rich, powerful, and connected enough to be one of the few people granted a State permit. I'm sure allocation of said permits had absolutely nothing at all to do with campaign donations, or promised future favors. Given that a permit is essentially a license to print money, there's no way the people who have them will ever allow the laws to be opened up to more people.
